Success CaseFor more than four decades, Rajes lived as a stateless person; deprived of education and pushed further into realm of poverty.  She possessed no legal identification as her birth was not registered by her Malaysian parents. Rajes realized the dire state of her situation when she was 15 years old.

Asha dedicated her life for the family since young. She helped with the upbringing 9 of her siblings. She was always proud of her big family. On the other hand, her father held no proper job. The main reason for this was his uncontrollable drinking habits. Moreover, fights frequently occurred between her parents. When Asha was 15 years old, a quarrel started of like any other daily quarrel. However, it changed Asha’s life. During the argument, it was revealed by the father that Asha was adopted. Very soon, quoting poverty and hardship, her adoptive father asked her to leave the house. To top this all… Asha had no  legal identification.

Identification Card_TaipingMr Seenivasan and Mr Veerammal were born in a General Hospital in Kedah. They obtained their birth certificate without any difficulties.

At the age of 11 and 10 respectively, they were taken to Sabah by their parents. Reaching the age of 12, they applied for Identification Card which they received - only to be taken back later by the National Registration Department.

The mother (Mrs. X), intends to claim compensation for the death of her son (A), a 4 year old, who died after falling into a drain within the vicinity of (K), a registered company providing rail services. The mother (Mrs. X) argues that the company (K) did not provide adequate safety measures which resulted in the death of her son (A).

Facts of the Case

The claimant now aged 52 years commenced employment with the Company on 18th February 1981 as a general worker. He was dismissed from his employment on 27th September 2002.

The Claimant’s issue with the said Company is not related to his work but to his occupation of Company quarters. As employee, the Claimant was allotted quarters. The tenancy agreement signed by the Claimant required him to live in the quarters without creating any disturbance to the other residents.
